Privacy Shield
In order to facilitate the identification of accredited entities to provide qualified trust services, the European Parliament and the Council has created a badge that makes it possible to identify easily the organizations that are officially accredited by the Governments of the European Union. Only officially accredited entities can make use of this badge. Accredited entities must also be published in the Trusted List (TSL) * in accordance with Regulation (EU) No. 910/2014 of the European Parliament and of the Council of 23 July 2014.
US
The US Government, for the purposes of law enforcement and national security, makes available to anyone in the EU for the first time, ways of recourse in the event of complaints about how its data has been managed, and whether by companies or the Government.
EU
Due to the signed agreements and new regulations applied in both EU and US, a US company that wants or needs to process data from European people must conform to the GDPR. Otherwise, it will be captured by the GDPR sanctions that have a cross-border reach.
US – EU
European companies can only exchange data with North American companies certified with Privacy Shield. The penalties can reach 20,000,000 euros, or 4% of its business, and even the closure of its activity. Regulation (EU) 2016/679.
